Service agreement
Terms of Service
These Terms govern your use of Tracknote’s website, mobile applications, Live Scout, music curation workspace, and related services.
Effective and last updated: August 26, 20261. Acceptance and eligibility
By creating an account or using Tracknote, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
You must be at least 16 years old and legally able to enter this agreement. If local law requires parental consent at a higher age, you must have that consent.
2. Accounts and security
Provide accurate information, keep your credentials secure, and promptly notify us of unauthorized use. You are responsible for activity under your account. You may not sell, transfer, impersonate, or share access in a way that compromises account security.
Google Sign-In and connected music services are optional and separate from your Tracknote account. Disconnecting a provider does not automatically delete your Tracknote account or private workspace.
3. What Tracknote provides
Tracknote supports music discovery, private Collection and review, deterministic set planning, playback links, export, sanitized playlist sharing, venue discovery, and ShazamKit-assisted Live Scout.
- Track and venue information may be incomplete, delayed, unavailable, or inaccurate.
- Live Scout recognition is probabilistic and does not guarantee a match.
- Venue timelines are delayed, validated projections—not a real-time promise that a track is currently playing.
- AI suggestions are drafts. Actual track IDs and ordering are grounded in available Collection data and deterministic checks, but you remain responsible for professional or performance decisions.
4. Acceptable use
You may not:
- use Tracknote unlawfully or infringe intellectual property, privacy, publicity, or other rights;
- upload malware, probe security, evade rate limits, scrape non-public data, or disrupt the service;
- spoof location, replay recognition events, manipulate venue timelines, or fabricate DJ or venue credentials;
- attempt to access another person’s private Collection, notes, location, tokens, or account;
- reverse engineer the service except where law expressly permits it; or
- use Tracknote to build surveillance, advertising profiles, or unauthorized music databases.
We may investigate suspected abuse and limit access to protect users, venues, providers, and Tracknote.
5. Your content and music rights
You keep ownership of content you submit, such as notes, reviews, cues, playlists, comments, role evidence, and prompts. You grant Tracknote a limited, worldwide license to host, process, reproduce, and display that content only as needed to operate, secure, and improve the service or comply with law.
You are responsible for having rights to material you provide and for deciding what to share. Tracknote does not grant rights to copyrighted recordings, artwork, lyrics, videos, provider catalogs, or venue branding. Playback and purchases occur under the applicable provider’s terms.
If you create a playlist share link, anyone with the link may view its sanitized public content until you revoke it.
6. Third-party services
Tracknote may connect to Google, Apple Music, YouTube, ShazamKit, Mapbox, and other providers. Spotify is limited to public catalog discovery and outbound track links; Tracknote does not connect Spotify accounts, import Spotify playlists, or use Spotify account playback. Provider availability, catalogs, authentication, pricing, and rules are controlled by them. We are not responsible for third-party services, and your use of them is governed by their terms.
Do not use Tracknote exports or provider links to infringe music licenses or venue policies.
7. Beta service, availability, and changes
We may add, modify, suspend, or discontinue features and may impose reasonable limits. We will try to provide notice when a material change affects active users, but urgent security or provider changes may take effect immediately.
Unless a separate paid plan is clearly offered and accepted, the beta does not require an in-app purchase or payment method.
8. Disclaimers
To the maximum extent permitted by law, Tracknote is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.
Tracknote is not an emergency, safety, navigation, legal, royalty-reporting, or rights-clearance service. Do not rely on venue locations, schedules, crowd or music activity for personal safety decisions.
Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.
9. Limitation of liability
To the maximum extent permitted by law, Tracknote and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, opportunities, or business interruption arising from the service or third-party providers.
Where liability cannot be excluded, it is limited to the greater of the amount you paid Tracknote in the 12 months before the event giving rise to the claim or USD 100, except where applicable law requires a different remedy. This section does not limit liability that cannot legally be limited.
10. Suspension, termination, and deletion
You may stop using Tracknote at any time and may permanently delete your account in the app under More → Password & Security → Delete Account. If you cannot access your account, see Support. We may suspend or terminate access for material violations, security risk, fraud, provider requirements, legal obligations, or discontinuation of the service. Where reasonable, we will provide notice and an opportunity to address the issue.
Sections that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive.
11. General terms
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles, except to the extent mandatory consumer law in your country applies. Courts with lawful jurisdiction in the Republic of Korea will have jurisdiction, subject to any non-waivable right to bring a claim elsewhere.
If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of operating or reorganizing Tracknote. These Terms and the Privacy Policy form the agreement about the service unless a specific feature provides additional terms.
